Criminal and regulatory proceedings often have significant collateral consequences on a client's professional license, employment status, and immigration status. For practitioners, a criminal conviction or specific sentence can trigger severe inadmissibility under IRPA. This course explores how to weigh and manage these implications to achieve a successful global resolution, highlighting the integration of collateral impacts into effective sentencing submissions.

2. Detailed Learning Objectives

• Advise clients on non penal collateral consequences of criminal or regulatory findings, specifically focusing on IRPA inadmissibility thresholds.
• Integrate collateral impact arguments into strategic sentencing submissions to mitigate automatic deportation risks or loss of status.
• Analyze IRPA s. 36 criminality and serious criminality provisions alongside Criminal Code sentencing outcomes (e.g., conditional discharges, suspended sentences, fines, imprisonment).
• Identify statutory limits on appeal rights before the Immigration Appeal Division (IAD) under IRPA s. 64 based on sentence length.
• Navigate inter professional collaboration protocols between criminal defense counsel, regulatory advocates, and immigration practitioners to safeguard client rights.
