Description

Administrative tribunal proceedings before bodies such as the Immigration and Refugee Board (IRB) and other administrative tribunals require a sophisticated mastery of administrative law principles, evidentiary rules, and the Statutory Powers Procedure Act (SPPA). Legal practitioners must navigate how digital evidence, electronic records, and specialized documentation are authenticated and admitted while ensuring procedural fairness and strict adherence to professional standards.

  • Learning Objectives:

    • Analyze and apply administrative law principles and the relaxed rules of evidence under SPPA s. 15(1) and IRB Division Rules (RPD, RAD, ID, IAD).
    • Master the authentication protocols for digital and electronic evidence, including messaging logs, social media, translated documents, and digital audit trails.
    • Execute secure and compliant electronic evidence filings using IRB Portals (MyCase), Case Center, and digital transmission standards.
    • Differentiate between admissibility and weight of evidence, specifically regarding hearsay, Country of Origin Information (COI), and National Documentation Packages (NDP).
    • Prepare, qualify, and introduce expert opinion evidence and specialized reports (e.g., medical, psychological, country condition expert reports) before IRB panels.
    • Formulate strategic responses to evidentiary objections, procedural breaches, and know when co counsel or specialized intervention is ethically required.
